General Information
1.1. These clauses are valid for the commercial operations carried out by: Torris Group S.R.L, VAT ID 438990, REG J40/4452/2021, address Str. Vlad Județul, Nr.52-54, Et.1, Ap.sad 2, Sector 3, Bucharest.
Hereinafter referred to as “Torris Group S.R.L” and “Client” and/or “User” – the natural person who places an order using the platform of the website http://aquapick.bg/ or through other methods explicitly mentioned in this contract and who purchases the products marketed by Torris Group S.R.L on www.aquapick.ro.
1.2. These constitute the framework in which the contractual relationships between the parties take place, and the customer has become aware of them by reading and accepting them at the time of placing the order or registering as a user on the website http://aquapick.bg/

Definitions
2.1. The following terms will have the meanings mentioned below in this contract:
SITE / DOMAIN – all information on the SITE that can be visited, viewed, or otherwise accessed through the use of digital equipment;
CONTENT – the content of the website, as well as any newsletter or email sent to USERS or CUSTOMERS by Torris Group S.R.L through electronic means and/or any other available means of communication, as well as any information communicated by any means by an employee of our company to the USER or CUSTOMER, according to the contact information specified or not by the latter; information related to the products, services, and/or rates practiced by Torris Group S.R.L in a certain period;
SERVICE – the electronic commerce service carried out exclusively on the available sections of the SITE, in the sense of granting the CUSTOMER the possibility to contract products and/or services using electronic means, as well as through other means of remote communication (e.g. telephone);
USER – a natural or legal person of public or private law who has or gains access to CONTENT, through any means of communication (electronic, telephone, etc.) or based on a usage agreement between Torris Group S.R.L and them;
ACCOUNT – the set consisting of an email address and a password that allow a single USER access to restricted areas of the SITE through which access to the SERVICE is made;
CUSTOMER – a natural person of public or private law who has or gains access to CONTENT and SERVICE, through any means (electronic, telephone, etc.) or based on a usage agreement between Torris Group S.R.L and them, who benefits from the products and/or services offered by Torris Group S.R.L and purchased by them using the SERVICE;
CONSUMER – any natural person or group of individuals constituted in associations, acting for purposes outside their commercial, industrial, or professional activity;
DOCUMENT – this document titled Terms and Conditions of Sale-Purchase;
NEWSLETTER – the periodic means of exclusively electronic information about the products, services, and/or promotions carried out by Torris Group S.R.L in a certain period, without any commitment from Torris Group S.R.L regarding the information contained therein;
TRANSACTION – the collection or reimbursement of an amount resulting from the sale of a product/service by Torris Group S.R.L to the Customer, regardless of the delivery method;
DISTANCE CONTRACT – the contract for the supply of products or services concluded between Torris Group S.R.L and a customer, a natural person, within the sales system organized by Torris Group S.R.L, which exclusively uses one or more means of remote communication before and upon the conclusion of this contract.
Contract Object
3.1. Contract Object: the commercialization of products by Torris Group S.R.L, in accordance with its commercial offer, between natural persons and Torris Group S.R.L through the website www.aquapick.ro.
3.2. These commercial clauses apply to all remote sales/purchase operations of goods concluded through the methods mentioned in this Document between natural persons and our company.
3.3. This Document establishes the terms and conditions for the use of the site / content / service by the user or client, in case they have not concluded a separate contract with Torris Group S.R.L, which will take priority.
3.4. At the time of registration, each User is obliged to read these clauses. Only individuals who expressly give their consent can acquire the status of Users and/or Customers of Torris Group S.R.L.
General Terms of Use of the Website/Service
4.1. Access to the SERVICE is exclusively provided by accessing the public website http://aquapick.bg/
4.2. Use, including but not limited to accessing, visiting, and viewing the content/service, implies the user’s or customer’s adherence to these clauses, unless the respective content has distinct usage conditions formulated.
4.3. By using the website/content/service, the User or Customer is solely responsible for all activities resulting from this activity. Additionally, they are liable for any material damages or damages of any other nature caused to the website, content, service, Torris Group S.R.L, or any third party with whom Torris Group S.R.L has contracts, in accordance with the current Romanian legislation.
4.4. In case the User or Customer does not agree and/or does not accept and/or revokes their consent for the document:
4.4.1. They waive: access to the service, other services offered by Torris Group S.R.L through the website, receiving newsletters and/or communications from Torris Group S.R.L of any nature (electronic, telephone, etc), without any further guarantee from Torris Group S.R.L.
4.4.2. Torris Group S.R.L will delete all data referring to them from the database, without any further obligation of either party towards the other, and without any party being able to claim damages.
4.5. The Client/User can change their decision to agree and/or accept the document at any time, in the form it will be available at that time.
4.6. To exercise the right provided in articles 4.4 and/or 4.5, they can contact Torris Group S.R.L, or use the links provided by Torris Group S.R.L for this purpose.
4.7. The Client cannot revoke the consent expressed in favor of the document during the execution of a Contract or until they have paid the value of all Unfulfilled Contracts to Torris Group S.R.L.
4.8. If the Client has paid the value of all Unfulfilled Contracts to Torris Group S.R.L and revokes their consent expressed in favor of the document during the execution of an Order, Torris Group S.R.L will cancel their order without any further obligation of either party towards the other, and without any party being able to claim damages.
4.9. Torris Group S.R.L reserves the right to modify or interrupt, temporarily or permanently, partially or in full, the services provided through this Site, with or without prior notice.
4.10. Torris Group S.R.L is not responsible for users or any third natural or legal person or institution for the modification, suspension, or interruption of services available through the website www.aquapick.ro.
4.11. Torris Group S.R.L can change the content and usage conditions of the website at any time. The new conditions become effective when published on the Site and are not retroactive.
4.12. Torris Group S.R.L reserves the right to make any changes to these provisions, as well as any changes to the website/its structure/services offered, including changes that may affect the website and/or any part of its content without prior notification to users.
4.13. Torris Group S.R.L reserves the right to introduce advertisements of any kind and/or links on any page of the Site, in compliance with the applicable law.

5.1. The informational/imagistic content presented on the website www.aquapick.ro is the intellectual property of Torris Group S.R.L.
5.2. The Client/User is not permitted to copy, transfer, modify, and/or otherwise alter, use, link to, display, include any content in any context other than the original one intended by Torris Group S.R.L, use the content or any part of it outside the Torris Group S.R.L website, remove the copyright notices of Torris Group S.R.L on the content, and participate in the transfer, sale, distribution of materials created by reproducing, modifying, or displaying the content, except with the express consent of Torris Group S.R.L.
5.3. Any content that the User or Client has or gains access to by any means is subject to this Document if the content is not accompanied by a specific and valid usage agreement between Torris Group S.R.L and them, and without any implicit or express warranty by Torris Group S.R.L regarding that content.
5.4. The Client/User can copy, transfer, and/or use the content solely for personal or non-commercial purposes, only to the extent that they do not conflict with other provisions of the document.
5.5. In case Torris Group S.R.L grants the Client/User the right to use certain content in the form described in a separate usage agreement, to which the User has or gains access following this agreement, this right only extends to that or those parts of the content defined in the agreement, only for the duration of the existence of this or these content on the site or for the period defined in the agreement, according to the conditions defined in the agreement, if applicable. It does not represent a contractual commitment from Torris Group S.R.L to the respective User, Client, or any other third party who has/gains access to this content transferred, through any means, and who may be or is harmed in any way by this content, during or after the expiration of the usage agreement.
5.6. No content transmitted to the User or Client through any means of communication (electronic, telephone, etc) or acquired by them through access, visiting, and/or viewing constitutes a contractual obligation from Torris Group S.R.L and/or an employee of Torris Group S.R.L who mediated the transfer of content, if applicable, regarding that content.
5.7. Any use of the content for purposes other than those expressly permitted by the document or the accompanying usage agreement, if applicable, is prohibited.

6.1. Torris Group S.R.L publishes on the website www.aquapick.ro its complete and accurate identification and contact details for Clients or Users.
6.2. By using the contact form or the service on the website, the User or Client allows Torris Group S.R.L to contact them through any available means, including electronic means.
6.3. Partial or complete completion of the contact form and its submission does not represent a commitment on the part of Torris Group S.R.L to contact the User or Client in any way.
6.4. Accessing the website www.aquapick.ro, using the information presented therein, visiting pages, sending emails or notifications addressed to Torris Group S.R.L are conducted electronically, by phone, or any other means of communication available to the User or Client of Torris Group S.R.L in electronic and/or telephone mode, including communication via email or announcements on the website.
Online Sales Policy
7.1. To be granted access to the service, the User must accept the provisions of the document.
7.2. Access to the service is allowed to any User.
7.3. The User is entirely responsible for maintaining the confidentiality of the password associated with their account access.
7.4. Each User will promptly notify Torris Group S.R.L of any unauthorized use of their password and account. Torris Group S.R.L will not be liable for any moral or material damages caused by Users’ failure to comply with this provision. In case the account of a User is used by other individuals, Torris Group S.R.L reserves the right to suspend or terminate that account and refuse all current or future attempts to use the Database.
7.5. Torris Group S.R.L reserves the right to limit the access of the User / Customer to the service based on their behavior towards Torris Group S.R.L, as well as in situations where the User uses inappropriate language on the site or in communications with Torris Group S.R.L or causes material or image damage to Torris Group S.R.L or its partners.
7.6. Sharing an account among multiple clients is prohibited. In the event such an occurrence is discovered, Torris Group S.R.L reserves the right to cancel or suspend the client’s access to content or services. Moreover, in this situation, the client/clients who use a single account together will no longer be eligible for Torris Group S.R.L’s special offers.
7.7. In the event a client has placed an order that has not been collected or has been canceled, Torris Group S.R.L reserves the right to block that client’s account with prior notice.
Products Sold
8.1. The products sold through the website www.aquapick.ro are new products and are accompanied by an invoice in accordance with the applicable legislation at the time of delivery. Products and services are offered subject to compliance with the provisions of this document and within the limits of available stock.
8.2. The prices of products presented on the website www.aquapick.ro include VAT and do NOT include delivery charges. Delivery costs vary depending on the payment method and/or the delivery location.
8.3. The purchase price printed on the invoice will be the same as the one found on the website www.aquapick.ro and determined by the customer advisor of Torris Group S.R.L at the time of order confirmation as a firm order.
8.4. Torris Group S.R.L does not offer any additional warranties beyond those provided by the applicable legislation regarding, including but not limited to, the operation of this site, information, accuracy of descriptions, content updates, products on the site, and their suitability for a specific purpose. Users expressly agree that the use of this site and the purchase of products or services are done at their own risk, with the sole exception being Torris Group S.R.L’s obligation to grant users the right of unilateral termination of the contract according to the applicable legislation, as detailed in this document.
The products sold on www.aquapick.ro have undergone testing and safe inspection.
Torris Group S.R.L provides a quality guarantee for the product for a period of 24 months from the date of purchase. Torris Group S.R.L will repair defective products under normal use during the warranty period. In case of difficulties encountered during the repair process, the product will be replaced with a new one.
Precautions
During the warranty period, repairs will be conducted at an additional cost in the following cases:
- The device is damaged due to improper use, mishandling, or negligence after purchase.
- The product is damaged, modified, or repaired by an unauthorized party other than Torris Group S.R.L.
- The product is damaged as a result of being connected to irregular power sources.
8.5. The images published on the website are for example/presentation purposes, and the products are not required to match 100% with those shown in the images in any way (there may be color differences in reality).
Validity of Prices and Special/Promotional Offers
9.1. Torris Group S.R.L reserves the right to modify the prices for products and/or services available on the site without prior notice to the User or Customer. In cases where an order has already been issued, the purchase price of products or services can only be changed with the agreement of both parties.
9.2. The purchase price of products from www.aquapick.ro and services is the one in effect at the time of order issuance, within the limits of available stock.
9.3. The purchase price of promotional products and services is the one in effect at the time of order issuance, within the limits of available stock and/or the promotional period, if defined.
9.4. Promotions displayed on the website www.aquapick.ro (price reductions, stock clearance, etc.) are exclusively applicable online.
9.5. The purchase price of products and/or services from a fulfilled contract cannot be changed.
9.6. The customer can withdraw from purchased products and services through an order, only within the period between order issuance and its transformation into a contract, provided that the chosen payment method is cash on delivery.
9.7. The customer can withdraw from purchased products and/or services through a contract, in accordance with the provisions of the applicable legislation.

Personal information means any type of information that identifies you personally (such as your name, address, or email). Payment and Delivery
Any order placed through the website http://aquapick.bg/ is a contractual commitment and implies the acceptance of the terms and conditions of use.
Product delivery is conducted through rapid courier services provided by Fan Curier, only within the territory of Romania.
Delivery will be completed within 12 hours, a service available only within the city of Bucharest, for orders collected from Monday to Friday until 6:00 PM.
The transportation cost is 20 Lei (for purchases with a value up to and equal to 50 Lei).
Delivery will take place within 24 – 48 hours in cities outside of Bucharest, from the confirmation of the order, except for legal holidays. In exceptional cases where the ordered product is not in stock at the time of order placement, our operators will inform you about the possibility of a later delivery date, without guaranteeing it. It’s possible that an out-of-stock product may not be restocked, and its price or characteristics may differ in a subsequent purchase.
Products that are not in stock cannot be delivered.
The tax invoice will be sent electronically to the provided email address.
For orders paid by card, the processing is done through Stripe as a payment processor and partner of http://aquapick.bg/. We do not store any card-related information, and http://aquapick.bg/ cannot be held responsible for any fraud involving the card used for placing the order. In the case of product returns for card-paid orders, their value will be refunded to the same card used for the order, as soon as the products reach the http://aquapick.bg/ warehouse and are verified.
For canceled orders that have already been dispatched to the customer, the refund of the order value will only be made after the returned package has been received.
The timeframe for card refunds from the moment of request by http://aquapick.bg/ to the payment processor may vary depending on its procedures, up to 48 hours.
Responsibilities Regarding Products
http://aquapick.bg/ guarantees replacement and/or acceptance of returns for products that are deemed inconsistent with the description on the website or with customer expectations within a 30-calendar day period from their delivery. http://aquapick.bg/ is not responsible for timely delivery of products if it depends on the courier company through which they were sent. Any complaints will be brought to the attention of http://aquapick.bg/ within a maximum of 24 hours from the receipt of the products, and it will be forwarded to the supplier of the respective products for resolution.
The displayed product stocks on the website may differ in certain situations from actual stocks; therefore, confirmation of products and/or orders will be exclusively done by telephone or email. An order confirmation received by email does not provide any guarantee regarding the reservation of products or stock availability and has no fiscal value.
The images presented on the site are illustrative; the actual products may differ in terms of color.
The maximum value of the obligations of http://aquapick.bg/ towards any customer in the case of non-delivery or improper delivery of purchased products is the value of the sums received by our company from that customer. In case prices or other product details have been displayed incorrectly, including due to incorrect entry into the database, http://aquapick.bg/ reserves the right to cancel the delivery of the respective product and to inform the customer about the error as soon as possible. Orders that are not confirmed by phone will be canceled.
Product Returns
In the event that the ordered product does not match the presentation on the http://aquapick.bg/ website or has manufacturing defects, you can request a replacement or a refund of its value within 14 calendar days from the moment you received it.
Within 14 calendar days, the customer must express their intention to return the product in writing. Personal care products can be returned only if they are sealed, unused, unsealed, or untested. The return can be done via courier or directly in the showroom.
Refunds will be made in full, without commissions, through the same payment methods used for purchasing the product.
Information on Exercising the Right of Withdrawal
You have the right to withdraw from this contract without stating reasons within 30 calendar days.
The withdrawal period expires after 30 calendar days starting from the day you or a third party other than the carrier, indicated by you, physically take possession of the products, or in the case of multiple goods ordered in a single order and delivered separately, the day you or a third party other than the carrier, indicated by you, physically take possession of the last product.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract, using an unequivocal statement sent by email, mail, telephone, SMS, or verbally to the contact details provided on http://aquapick.bg/ or any of the contact details made available for this purpose.
For this purpose, you can use the attached withdrawal model; however, its use is not mandatory.
To comply with the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.
ARTICLE 16 Exceptions to the Right of Withdrawal
- e) supply of sealed products that cannot be returned for reasons of health or hygiene protection and which have been unsealed by the consumer;
- f) supply of products that are, by their nature, inseparably mixed with other items after delivery;
Consequences of Withdrawal
If you withdraw, we will refund any amount we have received from you, including delivery costs, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and in any event, no later than 30 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will make this refund using the same payment method that you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not be charged any fees as a result of such refund.
We may withhold the refund until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earliest.
You shall send back the goods to the address of the warehouse from which they were dispatched, an address that you will receive in writing via email immediately after confirming the receipt of the withdrawal request, without undue delay and, in any case, within a maximum of 30 calendar days from the date you informed us of the withdrawal. The deadline is met if the goods are sent back before the 30-calendar day period expires.
You will have to bear the direct cost of returning the goods.
You are only responsible for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

According to Article 9 of Emergency Ordinance No. 34/2014 of June 4, 2014, regarding the consumer’s rights in contracts concluded with professionals, “the consumer has a period of 14 days to withdraw from a distance contract or from a contract concluded outside the commercial premises, without having to justify the withdrawal decision and without incurring any costs other than those provided for in Article 13 paragraph (3) and Article 14.”
According to Article 13 of Emergency Ordinance No. 34/2014
“(1) The professional (Torris Group S.R.L.) shall refund all sums received as payment from the consumer, including, where applicable, the delivery costs, without undue delay and, in any event, no later than 14 days from the date on which it is informed of the consumer’s withdrawal decision in accordance with Article 11.
(2) The professional shall make the refunds referred to in paragraph (1) using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise, and provided that the consumer does not incur any fees as a result of the refund.”
Consumer’s obligations in case of withdrawal, according to Article 14 of Emergency Ordinance No. 34/2014
“(1) Unless the professional has offered to retrieve the products himself, the consumer shall return the products or hand them over to the professional or to a person authorized by the professional to receive the products, without undue delay and within a maximum of 14 days from the date on which the consumer communicated his withdrawal decision to the professional in accordance with Article 11. The deadline is met if the products are sent back by the consumer before the 14-day period expires.
(2) The consumer bears only the direct costs related to the return of the products, except where the professional agrees to bear those costs or where the professional has not informed the consumer that these costs must be borne by the consumer. […]
(3) The consumer is only liable for any diminished value of the goods resulting from the handling of the goods, different from what is necessary to establish the nature, characteristics, and functioning of the goods. The decrease in value of the goods must not discourage the consumer from exercising his right of withdrawal. Regardless of the situation, the consumer is not responsible for the decrease in value of the goods if the professional has failed to inform him of the right of withdrawal in accordance with Article 6 paragraph (1) letter h).
(4) The professional must be able to prove the decrease in value of the goods resulting from handling them differently than is necessary to establish the nature, characteristics, and functioning of the goods.”
The returned products will be sent to the address of the Torris Group S.R.L. showroom, an address that will be communicated by the sales agent when the return is reported. The products MUST NOT be returned via Romanian Post and MUST NOT be shipped to any address other than the one specified by the sales agent.
Final Provisions
If any of the above clauses is found to be void or invalid, regardless of the cause, that clause will not affect the validity of the other clauses. With the purchase and initiation of the order, the customer accepts without objection the terms and conditions of use, the value of which is the same as a valid contract concluded.
The right to use the content – text and images – belongs exclusively to Torris Group S.R.L.
